The Eden Killer Whale Museum collection has been identified as being of national significance and the Museum’s aim is to use the collection:
- To enhance the Museum’s reputation by raising awareness of the unique working relationship of the whalers and Killer Whales of Twofold Bay;
- To aid the professional work of the Museum by providing research and learning resources; and
- To facilitate and generate excellent scientific, cultural, historical and other research
Research enhances knowledge of the collection, and thereby increases the value of the collection by supporting the engagement, professional support and collection development functions of the Museum. The purpose of this policy is therefore to encourage and foster excellent research into the Museums’ collections and practice, and to layout procedures to ensure such research is undertaken in a sustainable way.
Relationship to Eden Killer Whale Museum mission
Eden Killer Whale Museum Research Policy supports the Eden Killer Whale Museum’s mission of:
- Striving for excellence in the acquisition, care, interpretation and presentation of its collection, whilst maintaining their relevance to the public;
- Upholding the original reason for the establishment of the Museum; and
- Preserving the histories associated with local industry, outstanding citizens and the natural environment
Purpose of policy
The Eden Killer Whale Museum recognizes the value of its collections and the importance of preserving them as well as controlling their use. Therefore, the Museum has developed a Policy on the use of its collections and the use of Museum staff and volunteers for research.
The Eden Killer Whale Museum in no way wants to discourage the use of the Museum, therefore, pricing for these services have been established to encourage use of and access to Museum information and collections.
- “Commercial User” means anyone whose use of the Museum resources will generate revenue for that user
- “Public, Media & Non-Commercial User” means everyone who is not a Commercial User
- “Members” means any person or entity that is a financial member of ‘Eden Killer Whale Management Committee Incorporated’
The Museum will retain all rights to Museum-owned information. The Museum may provide Museum-owned information to educational institutions and public libraries for reference use only. The Museum must approve commercial use of Museum-owned information and resources prior to their use. The Museum may form partnerships to support initiatives that involve data sharing or data exchange. Parts of the Policy may be waived at the discretion of the Executive Panel or delegated person when the interests of the Museum or the Eden Community are served by such course of action.
Request for Research
All requests for research must be made using the Eden Killer Whale Museum ‘Research Request’ form. The Museum makes every effort to make materials accessible; however, some materials may be unavailable for reasons of conservation, copyright restriction, the protection on privacy or donor agreements.
No archival documents, photographs, research files, reference books, or negatives may be removed from the Museum Library or Collection. Requests are on a first come, first serve basis and in the case of urgent requests, the Museum reserves the right to refuse urgent requests where staff and volunteer resources are insufficient to allow a response in the time allotted.
No use is to be made of Eden Killer Whale Museum research information or photographic imagery other than that stated on the request form. No further reproduction or storage of imagery is to be carried out other than for the stated purpose and research information must not be handed to a second party for use.
The granting of permission to use Eden Killer Whale Museum photographic images or research information does not imply the transfer of copyright or exclusive rights to the material.
The applicant must complete and sign the request form and include payment for photographs and/or administration fees and the first hour of research charge. Any additional charges incurred for photocopying and additional hours of research will be forwarded to the applicant prior to the request proceeding.
Photographic imagery must be credited to Eden Killer Whale Museum, and must be printed in close proximity to the printed image(s) and the source information must be legible.
Research information must be credited to Eden Killer Whale Museum in the bibliography of the publication or credits of the production. Immediately after publication, the applicant agrees to supply the Eden Killer Whale Museum with a copy of the publication or production at no cost to the Museum.
In the case of photographic reproductions, permission is for one-time use only as described on the photograph order form, with no other rights.
Any subsequent use constitutes re-use and is strictly prohibited. Everyone must reapply in writing to the Eden Killer Whale Museum for permission to re-use a photographic reproduction. An additional fee may be charged for reuse.
All orders for photographic reproductions must be in writing and require at least two weeks advance notice. Advance payment is required as per the appropriate rate as set by the Eden Killer Whale Museum Schedule of Research Fees and Charges.
Copyright – Photographs
Where the name of the photographer or owner of a photograph is known and copyright has not been assigned to the Eden Killer Whale Museum, it is the responsibility of the person requesting the use of the photograph to obtain permission in writing from the copyright holder for such use prior to any copy of the image being released.
All photographs from the Eden Killer Whale Museum collection used for publication must be credited to the Eden Killer Whale Museum as per the information provided by the Eden Killer Whale Museum.
Commercial users of Museum staff, volunteers and information resources will be billed for use of these services as described in the Eden Killer Whale Museum Schedule of Research Fees and Charges.
Public, Media, and other Non-Commercial users of Museum staff, volunteers and information resources will be billed for use of these services as described in the Eden Killer Whale Museum Schedule of Research Fees and Charges.
Public, Media, and other Non-Commercial users are encouraged to conduct their own research, in person, using the Museum information resources. Members conducting their own research are not liable to pay the initial search fee but are liable for fees where additional searches are conducted by volunteers or the Collections Manager. All users are liable for all other fees outlined in the Eden Killer Whale Museum Schedule of Research Fees and Charges.
The physical collection is available, at Eden Killer Whale Museum, 184 Imlay St., Eden, to any “Commercial User”, “Public, Media & Non-Commercial User” or “Members” wishing to access the resources held.
Access to the collection is by appointment only with the Eden Killer Whale Museum Collections Manager, with at least four (4) weeks advance notice required. The Library and Research facilities are open to members and the public on specific days and times.
The Executive Panel will be responsible, in consultation with the Collections Manager and Library/Research Volunteers for determining access conditions which may be varied from time to time.
Access to the Library and Collection outside of normal operating hours can be arranged by appointment with the Collections Manager or delegated person.
